Terms of Use (User Agreement)
Contractor: SINKAI LLC (Ukrainian company code EDRPOU 39579920), 266 Shevchenka Blvd., office 5, Cherkasy, Ukraine (the "Platform", "we", "us").

1. Definitions
- Platform: the software suite at https://sinkai.net that allows you to create and administer websites (including online stores, educational and content projects).
- User / Administrator: an individual who has created an account and manages one or more Sites on the Platform.
- Account: the set of data that identifies the User.
- Site: a website created by the User with the means of the Platform.
- Content: any materials (texts, images, products, files) that the User posts through the Platform.
2. Subject of the Agreement
2.1. We provide the User with access to the Platform for creating and administering Sites on the terms of this Agreement.
2.2. This Agreement is a public offer. Registering an account (including through Google, Facebook or Apple) means full and unconditional acceptance of its terms.
2.3. If you do not agree with these terms, do not use the Platform.
3. Registration and account
3.1. Registration requires a valid email address and a name. Registration may be done through a third-party provider (Google/Facebook/Apple); in that case we receive profile data in accordance with the Privacy Policy.
3.2. The User undertakes to provide accurate data and to keep it up to date.
3.3. The User is solely responsible for keeping access to their account secure and for all actions taken under it. Unauthorized access must be reported immediately to support@sinkai.com.ua.
3.4. One account is intended for one person. Giving access to third parties is prohibited.
4. Terms of social sign-in
4.1. Signing in through Google/Facebook/Apple is an additional convenience. We use the data received only for authentication and for creating the account, and we do not post anything on the User's behalf.
4.2. The User can disconnect a provider at any time in the "Profile → Sign-ins" section.
4.3. Use of Facebook Login components is also subject to the Meta Platform Terms and the Meta Platform Policies.
5. Rights and obligations of the User
The User has the right to:
- create and administer Sites within the selected plan;
- receive support within the limits defined by the plan;
- delete their account at any time.
The User undertakes not to:
- violate the laws of Ukraine and of the country where they or their audience are located;
- post Content that infringes intellectual property rights, contains defamation, calls to violence, discrimination, malicious software, sexual material involving minors, or is otherwise unlawful;
- use the Platform for spam, phishing, fraud, circumvention of security systems, or excessive load on the infrastructure;
- resell access to the Platform without written consent;
- attempt to gain access to other people's accounts or data.
6. User Content
6.1. All Content belongs to the User (or to the rights holders). We do not acquire any rights to it, other than a limited license to store, reproduce and display the Content solely for the purpose of providing the service.
6.2. The User warrants that they have all rights to post the Content and bears full responsibility for it.
6.3. We have the right to remove Content or suspend a Site without notice if there are reasonable grounds to believe that it is unlawful or violates this Agreement, and also to comply with a lawful request.
7. Payment
7.1. Some features are provided for a fee according to the plans published on the Platform. New Users may be offered a free trial period.
7.2. Payment is made in advance. The service is considered properly rendered if no reasoned claim is received during the billing period.
7.3. Refunds are made in accordance with consumer protection legislation and the Platform's pricing policy.
7.4. In case of non-payment we have the right to restrict or suspend access after the grace period ends.
8. Service availability
8.1. We make reasonable efforts to keep the Platform running without interruption, but we do not guarantee the absence of outages. Planned maintenance is possible; we announce it in advance where possible.
8.2. The service is provided "as is". We do not guarantee that it will meet all of the User's expectations.
9. Liability
9.1. We are not liable for: User Content; actions of third parties (including payment and social providers); loss of data resulting from the User's actions; lost profit.
9.2. The Platform's total liability on any grounds is limited to the amount paid by the User for the services during the last [3] months.
9.3. These limitations do not apply where they are prohibited by law.
10. Suspension and termination
10.1. The User may stop using the service at any time by deleting their account (see the data deletion instructions).
10.2. We may suspend or terminate access in case of a material breach of this Agreement, in particular posting unlawful Content or non-payment.
10.3. After termination, data is processed in accordance with the Privacy Policy.
11. Changes to the terms
We may change this Agreement. We will notify you of material changes by email or by a notification in the admin panel at least 14 days before they take effect. Continued use after that date means acceptance of the new terms.
12. Governing law and disputes
12.1. This Agreement is governed by the laws of Ukraine.
12.2. Disputes are resolved through negotiations and, if no agreement is reached, in court in accordance with the laws of Ukraine [or: at the location of the Contractor].
